Podcast 252 – Dealing With Trustee Sales Dates

Michael Quarles covers dealing with a trustee sales date.

  • I have a lead that has a good amount of equity ($100k+) but due to divorce she is now in heading to foreclosure with trustee sale scheduled for 10 days. Now she is ok walking away with some money in her pocket and selling the home to us wholesale after we stop it from foreclosure. The problem just came up that the title is held in joint tenancy with husband who she no longer has communication with due to the divorce. Is there any way around this issue, or should I chalk it up as a loss?

  • Does a house with no mortgage but has a home equity line of credit affect selling the house on a contract for deed?
  • I’ve seen some “We buy cash” statements on the websites and yellow letter samples of other rehabbers. I’ve also heard the same rehabbers talk about how they use hard or private money to finance their deals. I’m wondering if I’m misunderstanding what “We buy cash” means.If you’re using private or hard money, you’re financing, not buying cash,right?

Podcast 250 – Should You Use Your Personal Money to Invest

Michael Quarles covers whether or not you should use your personal money to purchase properties!

  • I recently inherited about $100K, and I would like to invest it in real estate. I live in southern CA where there are no more real estate bargains, but properties seem to keep appreciating at pretty high rates. $100K won’t get me any properties free and clear, but it would be a good(25%) down payment on perhaps two one-bedroom condos that might rent for about $1200 each. 
  • Would I do better investing my inheritance out of state? California property taxes are favorable as is appreciation in general. What is your advice: stay in California or go out of state, and if out of state, what area?

  • I buy an HOA lien through foreclosure and get on title. If the borrower is deceased, and the 1st lien payoff balance is less than market value, can I sell the property?
  • If a seller is willing to carry back a portion of the purchase price but wants a substantial down payment, can I go to a bank to get financing for the down payment?
  • Are there any downfalls to wholesaling a property with tenants?
  • How do you manage your leads and deal flow?
  • I don’t hear too many investors talking about buying at auctions, is it because it is too risky? Should buying properties at auctions be avoided?

Podcast 248 – Buying a Home With Tenants In It

Michael Quarles covers whether or not you should purchase a home with a tenant in it.

  • I’ve come across a deal on a rural property, numbers are great.  Not a bad area, probably B-.  Just rural.  Homes selling on the high end for the region. The owner wants to get rid of the property because he’s let his sister live there who is married to a violent criminal with 17 assaults on his record. Last time owner was at the property, husband answered the door with a gun to his face. So needless to say, I will not be touring the house or property.  Number is low enough that I don’t feel like I have to anyway. There is no written lease in place.  Owner says they are “squatting.”  92-year old father is also there “squatting.”  My plan is to wholesale, but I can’t really show any potential buyers inside.  I don’t really want to pass this problem of a violent (and now even more pissed off) criminal on to any of my buyers either. What would you do?

  • Am I violating any laws by putting on my business card “$500 cash for any lead that closes”?
  • 2. I have an account with Propelio and they send me a daily list of new probates & appt. of sub trustees. How frequently I should send mail out to these leads?
  • 3. How aggressive is too aggressive when it comes to following up?  (read:  how many times can I call per day before she considers restraining order options)
  • 4. After you speak with a lead, what information do you enter into your CRM?
  • 5. If I budget $500/month for marketing, should I do more houses & use only postcards or should I vary my material (which costs more) and do fewer
    houses?

Podcast 246 – Buying a House Subject-To

Michael Quarles covers buying a home subject-to the existing mortgage.

  • I located a house, let’s say $150,000 ARV it has $35,000 in equity, needs no work, seller decides to get rid of it for $115,000.  I decide to take over his mortgage subject to his original financing.  I simply take over the deed/note,start making payments on behalf of the seller and have conditions/exit strategies in place just in case the due on sales clause is exercised to prevent the original seller from facing a financial crisis if it defaults. (Either sell it,assign back to owner, etc)
  • Should I be concerned with any language in Dodd Frank? Or is this more of an issue with Lease Options where credits are being applied to the purchase price of the mortgage on the option to buy?

Michael Quarles covers how you should speak to sellers when you are a brand new investor!

  • Our house in Oildale has an extra, non-permitted bedroom built into the garage. First, I was thinking we would have to tear it out as part of our rehab, but now I’m wondering if we should just clean it up and sell it the way it is. Will FHA still loan on a house with a garage conversion?

  • I haven’t officially done a deal yet. What can I say when someone asks, “How many houses have you bought so far?” or Where do you get all the cash?”

  • I struggle with the limiting belief that my age (23) and young looks (18 ) keep sellers from taking me seriously face to face. Is the belief true? How can I overcome this problem?

  • For our marketing chart, what exactly does it mean when a zip code with 5 times as many cash transactions ranks halfway down the list as others?

  • If I write a letter to an out-of-state absentee owner asking him if he is interested in selling, and he agrees, how can I view the interior of the property to view the condition and make my final offer?
